1. Overview

By accessing and using our website (“Site”), you (“User”, “you”, “your”) agree to be bound by these Terms and Conditions (“Terms”). The terms “we,” “us,” and “our” refer to Maison Merkaba (“Company”), the owner of this Site. To use the Site, you must be at least 18 years old and possess the legal authority to enter into these Terms. You may be required to provide personal information such as your name and email address. You agree that all registration information provided will be accurate, current, and complete. You may only use the Site for lawful purposes. You must not post or transmit any material that infringes the rights of others, is defamatory, abusive, invasive of privacy, or otherwise objectionable. You must comply with all applicable laws in your jurisdiction when using the Site.

Capitalized terms used herein shall have the meanings assigned below or elsewhere in these Terms:

- Affiliate: Any entity that controls, is controlled by, or is under common control with a party, where “control” means ownership of 50% or more of voting securities

- Country: The Netherlands

- Services: The services provided by the Company, its employees, or service providers.

3. Acceptance of Terms

These Terms govern your use of the Services and constitute a binding agreement between you and the Company. By using the Site, you acknowledge that you have read, understood, and agreed to these Terms. We reserve the right to modify these Terms at any time. Changes will be posted on the Site, and continued use of the Site constitutes acceptance of the revised Terms. Your use of the Services is also subject to our Privacy Policy, which outlines how we collect, use, and protect your personal information. Please review it carefully. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site or Services without our express written consent.

4. Reservations

To secure your preferred appointment time, we recommend booking in advance via the contact page.

5. Changes and Cancellations

We kindly request at least 24 hours’ notice for rescheduling or cancellations. Appointments canceled with less than 24 hours’ notice will incur a cancellation fee equal to 50% of the appointment fee.

6. Arrival and No-Shows

Please arrive no earlier than 10 minutes before your scheduled session. Late arrivals will result in a shortened session to avoid delays for subsequent clients. We will wait up to 15 minutes for late arrivals. If you fail to attend without prior notice, the full session fee will be charged.

7. Force Majeure

We shall not be liable for delays or failures in performance due to circumstances beyond our reasonable control, including but not limited to illness, natural disasters, governmental actions, strikes, or supply chain disruptions.

8. Consultation

Before each session, a brief consultation may be conducted to tailor the treatment to your needs.

9. Security

Please avoid bringing valuables to the premises. We are not responsible for any lost or unattended items.

10. Health Conditions and Pregnancy

Please disclose any medical conditions and/or medication you are taking during booking or to the practitioner at your appointment.

11. Disclaimer and Client Consent

Services are provided “as is” and “as available,” without warranties of any kind. The Company, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers and service providers shall not be liable for any damages arising from use of the Services. Reiki is a complementary therapy and not a substitute for medical or psychological treatment. Practitioners do not diagnose or interfere with professional care. Testimonials are based on individual experiences and are for informational purposes only.

12. Indemnification

You agree to indemnify and hold harmless the Company our directors, officers, employees, affiliates, agents, contractors, interns, suppliers and service providers from any claims, liabilities, or expenses arising from your breach of these Terms or violation of any law or third-party rights.

13. Limitation of Liability

Under no circumstances shall we be liable for any damages arising from your use of the site or services, including but not limited to direct, indirect, incidental, consequential, or punitive damages.

14. Confidentiality

All client interactions, including session content and communications, are treated as confidential. This includes in-person and distance sessions, telephone requests, email exchanges, scheduling or appointment notes, session content records, and any progress notes taken during sessions.

15. Errors and Omissions

We reserve the right to correct any errors or inaccuracies in the Services or Site content without prior notice. We are not obligated to update information unless required by law.

16. Prohibited Uses

You may not use the Site or its content for any unlawful purpose, including but not limited to:

- Violating laws or intellectual property rights

- Submitting false information

- Collecting personal data without consent

- Engaging in spamming, phishing, or scraping.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

18. Waiver and Entire Agreement

Failure to enforce any provision shall not constitute a waiver. These Terms constitute the entire agreement between you and the Company regarding the Services.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands.
